Terms of Service for The Catholic Navigator (TCN)

These Terms of Service (“Terms”) govern your use of the website operated by The Catholic Navigator LLC (“TCN,” “we,” “our,” or “us”), including any purchases, inquiries, communications, or participation in travel-related services or merchandise orders. By accessing or using this site, you agree to be bound by these Terms.

If you do not agree, you must discontinue use of this website immediately.

1. Overview of Services

The Catholic Navigator LLC provides:
• Travel-related curation, advisory services, and trip design concepts;
• Connections to third-party tour operators, including but not limited to 206 Tours and World Expeditions;
• Limited direct services, when offered;
• An online merchandise shop operated through WooCommerce and Printful.

TCN may also offer additional services or promotions from time to time, including sweepstakes or giveaways, which will be governed by separate posted rules.

TCN is not the tour operator of record for most itineraries. Unless explicitly stated otherwise, all travel bookings are fulfilled, operated, and governed by third-party tour operators and their terms, policies, and conditions.

2. Third-Party Travel Operators

For most itineraries, travel is provided by independent third-party tour operators such as 206 Tours or World Expeditions. Their terms govern all aspects of the booking, payment, itinerary changes, cancellations, accommodations, travel conditions, and service execution.

By booking any travel arranged or referenced through TCN, you acknowledge and agree that:
• The third-party operator, not TCN, is solely responsible for delivering and managing the trip;
• Payments, refunds, cancellations, and itinerary modifications are subject to the operator’s policies;
• TCN has no control over and is not liable for the acts, omissions, defaults, or performance failures of any operator, airline, hotel, transportation provider, or other vendor.

TCN’s role is limited to curation, communication, or facilitation unless explicitly stated otherwise.

3. Payments to TCN

If a service fee, deposit, or payment is made directly to TCN (rather than to a travel operator):
• All payments are final and non-refundable, unless otherwise required by law;
• Services delivered by TCN are advisory or facilitative in nature and are provided as described at the time of purchase.

Merchandise purchases follow a separate policy as outlined below.

4. Merchandise Orders

TCN operates a print-on-demand shop using WooCommerce + Printful.

All merchandise sales are final, except in cases of damage, misprint, or manufacturing error as determined by Printful’s replacement policy.

Returns for reasons such as change of mind, incorrect size choice, or buyer error are not accepted.

5. Eligibility and Age Requirements

This website is intended for users who are 18 years of age or older.

Minors may participate in travel itineraries only if the third-party operator permits minors and only when accompanied by a parent or legal guardian, subject to the operator’s policies.

Parents and guardians are responsible for all actions and agreements made on behalf of minors.

6. User Content (Comments and Reviews)

You may post comments or reviews where enabled. By posting content, you agree not to submit anything unlawful, defamatory, abusive, harmful, or otherwise inappropriate.

TCN may remove content at its discretion.

User-submitted content does not represent the views of TCN.

7. Intellectual Property

All logos, trademarks, text, images, media, and other materials on this website are owned by TCN or its licensors. You may not copy, reproduce, modify, distribute, or use any content without prior written permission.

8. Disclaimer of Warranties

All services, information, and content on this website are provided “as is” without warranties of any kind.

TCN does not guarantee the accuracy, reliability, availability, or completeness of any information, itinerary, schedule, or content.

Travel conditions may change without notice due to third-party actions, government restrictions, weather, health events, operational decisions, or other factors outside TCN’s control.

9. Limitation of Liability

To the fullest extent permitted by law, TCN is not liable for:
• Injury, illness, damages, losses, delays, cancellations, or failures caused by third-party operators or vendors;
• Acts of God, force majeure events, weather conditions, natural disasters, or government actions;
• Airline delays, border issues, passport or visa problems, or traveler negligence;
• Indirect, incidental, punitive, special, or consequential damages.

Your sole remedy for dissatisfaction with the website is to discontinue use.

10. Mandatory Informal Dispute Process (30 Days)

Before filing any claim, users must first attempt to resolve the issue directly with TCN.
You must email [email protected] within 30 days of the event giving rise to the dispute and include:
1. Your name and contact information;
2. A detailed description of the issue;
3. The specific resolution you are requesting;
4. Any relevant documentation.

TCN will attempt to resolve the issue in good faith within 30 days after receiving your notice.

If the issue cannot be resolved informally, the dispute proceeds under Section 11.

11. Dispute Resolution (Arbitration + Small Claims Carveout)

After completing the informal dispute process:

• Most disputes must be resolved through binding arbitration, administered by a recognized arbitration provider under its rules.
• Arbitration will take place in Virginia unless otherwise required by law.
• You and TCN waive the right to a trial by jury.

Exception – Small Claims: Either party may bring an eligible individual claim in small-claims court in the user’s home jurisdiction rather than arbitration.

Class Actions Waived: Disputes must be brought individually and not as part of a class action or collective proceeding.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

13. Changes to These Terms

TCN may update these Terms at any time. The updated Terms will be posted on this page with a revised Effective Date.

Continued use of the website constitutes acceptance of the revised Terms.
